Den sambo som \u00e4ger en mindre andel (eller ingen del alls) av bostaden, alternativt har st\u00f6rre skulder \u00e4n den andre sambon, kan beg\u00e4ra bodelning och d\u00e4rmed f\u00e5 en ekonomisk f\u00f6rdel.<\/p>\n\n\n\n<p><strong>Vad \u00e4r samboegendom?<\/strong><\/p>\n\n\n\n<p>Samboegendom \u00e4r ett centralt begrepp i den svenska Sambolagen och det f\u00e5r egentligen betydelse f\u00f6rst n\u00e4r ett sambof\u00f6rh\u00e5llande upph\u00f6r. Redan n\u00e4r man flyttar ihop \u00e4r det d\u00e4rf\u00f6r viktigt att veta vilken egendom som lagen reglerar.<\/p>\n\n\n\n<p>Enligt Sambolagen utg\u00f6r samboegendom bostad som \u00e4r inf\u00f6rskaffad f\u00f6r att utg\u00f6ra den gemensamma permanentbostaden, samt bohag som \u00e4r inf\u00f6rskaffat till denna bostad. Denna egendom \u00e4r vad som kan bli f\u00f6rem\u00e5l f\u00f6r bodelning enligt Sambolagen. Det avg\u00f6rande \u00e4r att egendomen f\u00f6rv\u00e4rvats f\u00f6r gemensam anv\u00e4ndning. Att det kanske endast \u00e4r en som har finansierat bostaden och ensam \u00e4ger den har allts\u00e5 ingen betydelse.<\/p>\n\n\n\n<p>Sambornas \u00f6vriga tillg\u00e5ngar, som kapital, v\u00e4rdepapper, bilar, b\u00e5tar och fritidsfastigheter, utg\u00f6r inte samboegendom och omfattas inte av bodelningsreglerna. Inte heller egendom som \u00e4r avsedd att huvudsakligen anv\u00e4ndas f\u00f6r fritids\u00e4ndam\u00e5l betraktas som samboegendom. Sj\u00e4lvklart kan samborna \u00e4ga andra tillg\u00e5ngar gemensamt, till exempel ett fritidshus. Det man dessf\u00f6rinnan \u00e4gt omfattas inte av Sambolagens regler om bodelning, f\u00f6rutsatt att det inte \u00e4r inf\u00f6rskaffat f\u00f6r att ha i den nya bostaden n\u00e4r man flyttat ihop.<\/p>\n\n\n\n<p>Det kan vara sv\u00e5rt att komma ih\u00e5g n\u00e4r olika saker inf\u00f6rskaffats. D\u00e4rf\u00f6r kan det vara bra att g\u00f6ra en f\u00f6rteckning av s\u00e5dant som <strong><em>inte<\/em><\/strong> \u00e4r samboegendom. Bild: Shutterstock.<\/figcaption><\/figure>\n\n\n\n<p><strong>Hur ska man t\u00e4nka vid bostadsk\u00f6p?<\/strong><\/p>\n\n\n\n<p>Den kanske vanligaste situationen som p\u00e5kallar juridisk r\u00e5dgivning \u00e4r n\u00e4r sambor eller blivande sambor ska k\u00f6pa en bostad och samborna g\u00e5r in med olika ekonomiska insatser. &nbsp;Ofta vill de \u00e4ga den gemensamma bostaden med h\u00e4lften vardera, men \u00e4nd\u00e5 s\u00e4kerst\u00e4lla att kapitalet som var och en investerat \u00e4r tryggat i h\u00e4ndelse av separation eller d\u00f6dsfall.<\/p>\n\n\n\n<p>Vi tar ett exempel:&nbsp;<\/p>\n\n\n\n<p>Lisa och Pelle k\u00f6per en bostad f\u00f6r 10 miljoner kronor. Lisa g\u00e5r in med 3 miljoner kontant och Pelle med 1 miljon. Resterande 6 miljoner finansieras genom ett gemensamt l\u00e5n.<\/p>\n\n\n\n<p>Om paret betalat lika mycket utifr\u00e5n sina \u00e4garandelar i den nya bostaden hade de g\u00e5tt in med 2 miljoner var. Nu har Lisa i detta fall betalat 1 miljon \u201df\u00f6r mycket\u201d. Vad kan h\u00e4nda om de separerar?<\/p>\n\n\n\n<p>Enligt Sambolagen utg\u00f6r bostaden samboegendom om den anskaffats f\u00f6r gemensam anv\u00e4ndning. Vid en separation kan Pelle beg\u00e4ra bodelning och han har d\u00e5 r\u00e4tt till halva l\u00e4genhetens v\u00e4rde.<\/p>\n\n\n\n<p>F\u00f6r att Lisa ska vara skyddad inf\u00f6r en s\u00e5dan situation b\u00f6r paret uppr\u00e4tta tv\u00e5 dokument. F\u00f6r det f\u00f6rsta ett samboavtal, d\u00e4r de avtalar bort best\u00e4mmelserna om bodelning av den gemensamma bostaden. F\u00f6r det andra ett skuldebrev, som visar att Lisa har en fordran p\u00e5 Pelle p\u00e5 1 miljon. Lisa ju har \u201dl\u00e5nat ut\u201d 1 miljon till Pelle. I skuldebrevet reglerar de om det ska utg\u00e5 r\u00e4nta och om skulden ska amorteras. Beg\u00e4ran om bodelning m\u00e5ste framst\u00e4llas inom ett \u00e5r fr\u00e5n det att sambof\u00f6rh\u00e5llandet upph\u00f6rde. Detta kan j\u00e4mf\u00f6ras med vad som g\u00e4ller vid \u00e4ktenskapsskillnad, d\u00e4r det inte finns n\u00e5gon egentlig yttre tidsfrist f\u00f6r att beg\u00e4ra bodelning.<\/p>\n\n\n\n<p><strong>Vem har r\u00e4tt att \u00f6verta bostaden?<\/strong><\/p>\n\n\n\n<p>Vid separation mellan sambor har den som b\u00e4st beh\u00f6ver den gemensamma bostaden r\u00e4tt att ta \u00f6ver den om synnerliga sk\u00e4l finns. Det g\u00e4ller dock endast bostadsr\u00e4ttsl\u00e4genhet och hyresr\u00e4tt, inte fastighet. Detta \u00e4r n\u00e5got som samborna inte sj\u00e4lva kan avtala bort. Har man br\u00f6starvingar, det vill s\u00e4ga barn, \u00e4rver de sin f\u00f6r\u00e4lder direkt. F\u00f6r att trygga den efterlevande sambon kan det d\u00e4rf\u00f6r vara n\u00f6dv\u00e4ndigt att skriva testamente, s\u00e5 att sambon \u00e4rver den avlidnes andel av den gemensamma bostaden.&nbsp;<\/p>\n\n\n\n<p>Har man inga barn \u00e4rver f\u00f6r\u00e4ldrar, syskon, syskonbarn, eller f\u00f6r\u00e4ldrars syskon den avlidnes egendom, \u00e4ven samboegendom. Finns inga s\u00e5dana sl\u00e4ktingar heller, d\u00e5 g\u00e5r arvet till Allm\u00e4nna arvsfonden. \u00c4ven i dessa fall \u00e4r det allts\u00e5 viktigt att skriva testamente.<\/p>\n\n\n\n<p><strong>Vem \u00e4r f\u00f6rm\u00e5nstagare till f\u00f6rs\u00e4kringar?<\/strong><\/p>\n\n\n\n<p>I de flesta f\u00f6rs\u00e4kringar, som livf\u00f6rs\u00e4kringar, tj\u00e4nstepensionsf\u00f6rs\u00e4kringar, privata pensionsf\u00f6rs\u00e4kringar och kapitalf\u00f6rs\u00e4kringar, \u00e4r make\/sambo f\u00f6rm\u00e5nstagare i f\u00f6rsta hand. Till skillnad mot arv \u00e4r det allts\u00e5 oftast sambo som f\u00e5r utfallet av f\u00f6rs\u00e4kringen och inte den avlidnes barn. Det \u00e4r viktigt att se \u00f6ver sina f\u00f6rm\u00e5nstagarf\u00f6rordnanden s\u00e5 att de st\u00e4mmer \u00f6verens med det man vill. Ett f\u00f6rm\u00e5nstagarf\u00f6rordnande g\u00e5r att \u00e4ndra via f\u00f6rs\u00e4kringsbolaget.<\/p>\n\n\n\n<p><strong>Ta juridisk hj\u00e4lp<\/strong><\/p>\n\n\n\n<p>Sammanfattningsvis kan det av juridiska sk\u00e4l vara angel\u00e4get att man som sambos ser \u00f6ver vad som g\u00e4ller enligt Sambolagen, men \u00e4ven vad som sker vid ett d\u00f6dsfall.
