F\u00f6r \u00e4ven om du \u00e4r svensk medborgare kommer du att p\u00e5verkas av den utl\u00e4ndska lagstiftningen, inte minst n\u00e4r det g\u00e4ller skatter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Familjejuridiken f\u00e5r inte heller gl\u00f6mmas bort. Svaret \u00e4r att \u00e4ven om du k\u00f6per en fritidsbostad i ett annat land, d\u00e4r du kanske vistas n\u00e5gra veckor per \u00e5r, \u00e4r du som huvudregel fortsatt obegr\u00e4nsat skattskyldig i Sverige. Det inneb\u00e4r att du fortsatt ska betala skatt i Sverige f\u00f6r samtliga dina inkomster, oavsett om de kommer fr\u00e5n Sverige eller n\u00e5got annat land.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">T\u00e4nker du hyra ut fritidsbostaden den tid du och familjen inte \u00e4r p\u00e5 plats? H\u00e4r \u00e4r det viktigt att st\u00e4mma av med en eventuell bostadsr\u00e4ttsf\u00f6rening s\u00e5 att uthyrning (via Airbnb eller liknande) \u00e4r till\u00e5tet. Du b\u00f6r ocks\u00e5 vara medveten om att inkomster fr\u00e5n uthyrningen ska beaktas i din inkomstdeklaration i Sverige. Beskattas hyresinkomsten \u00e4ven i det land d\u00e4r bostaden ligger \u00e4r det bra att ta reda p\u00e5 hur dubbelbeskattningsavtalet l\u00e4nderna emellan ser ut. Ett dubbelbeskattningsavtal som Sverige slutit med ett annat land avg\u00f6r vilket av l\u00e4nderna som har den prim\u00e4ra beskattningsr\u00e4tten till hyresinkomsten, samt var ett eventuellt yrkande om avr\u00e4kning ska ske. Syftet med dubbelbeskattningsavtalen \u00e4r just att undvika att samma inkomst beskattas dubbelt.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Med tiden kanske du och familjen b\u00f6rjar vistas mer och mer i bostaden utomlands och d\u00e5 kan det givetvis vara bra att se \u00f6ver er skattestatus i Sverige eftersom den kan komma att f\u00f6r\u00e4ndras.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Arvsskatt och testamente<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sedan 2015 har vi en ny arvslagstiftning som bygger p\u00e5 ett EU-f\u00f6rordnande och den inneb\u00e4r kortfattat att det \u00e4r hemvistlandets arvslagar som g\u00e4ller. \u00c4ven om du inte har flyttat ut fr\u00e5n Sverige kanske du vistas merparten av \u00e5ret, det vill s\u00e4ga mer \u00e4n sex m\u00e5nader per \u00e5r, i fritidsbostaden. Av den anledningen \u00e4r det nog m\u00e5nga som inte t\u00e4nker p\u00e5 att de kan beh\u00f6va betala utl\u00e4ndsk arvsskatt f\u00f6r egendom i andra l\u00e4nder. Men s\u00e5 kan bli fallet om en svensk \u00e4gare till en bostad i utlandet avlider. \u00c4ven om du som bostads\u00e4gare skriver att \u201dsvensk lag ska g\u00e4lla\u201d i ett eventuellt testamente tar det inte bort skyldigheten f\u00f6r efterlevande make, barn eller andra arvingar att betala eventuell arvsskatt i det landet.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Det kan vara klokt att skriva ett testamente i det land d\u00e4r bostaden ligger. Viktigt att beakta \u00e4r att det utl\u00e4ndska testamentet inte skrivs s\u00e5 att det raderar ett tidigare uppr\u00e4ttat testamente i Sverige. Dessa skatter finns dock i flera andra l\u00e4nder och kan \u00e4ven till\u00e4mpas p\u00e5 personer som i \u00f6vrigt \u00e4r att betrakta som begr\u00e4nsat skattskyldiga (p\u00e5 engelska <em>non-residents<\/em>). Gr\u00e4nsen f\u00f6r n\u00e4r du blir skattskyldig i det andra landet kan s\u00e5ledes variera.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Vi rekommenderar att du tar hj\u00e4lp av en r\u00e5dgivare eller jurist som har n\u00e4rvaro och kunskap om s\u00e5v\u00e4l skatter som familjejuridik, b\u00e5de Sverige och det land du k\u00f6per bostaden i, f\u00f6r att n\u00e4rmare kunna s\u00e4tta dig in i vilka regler som \u00e4r till\u00e4mpliga f\u00f6r dig.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Alla l\u00e4nder har sina egna regelverk och lagstiftningar.
