Dels det rent praktiska runt sj\u00e4lva g\u00e5vobrevet, dels n\u00e4r det g\u00e4ller \u00e4gande och r\u00e4ttvisa mellan syskon. H\u00e4r ber\u00e4ttar Private Bankings familjer\u00e4ttsjurist Emma Forsberg mer om reglerna och besvarar n\u00e5gra vanliga fr\u00e5gor.<\/p>\n\n\n\n<p><strong>Hur skriver man ett g\u00e5vobrev?<\/strong><\/p>\n\n\n\n<p>Ett g\u00e5vobrev \u00e4r ett skriftligt fysiskt dokument och det ska inneh\u00e5lla uppgifter om g\u00e5vogivare och g\u00e5votagare och personnummer f\u00f6r dessa. Tillsammans med en \u00f6verl\u00e5telsef\u00f6rklaring ska \u00e4ven fastighetens fastighetsbeteckning anges.<\/p>\n\n\n\n<p>\u00c4r det hela fastigheten eller bara en del som \u00f6verl\u00e5ts? Av g\u00e5vobrevet ska det tydligt framg\u00e5 vilka fastighetsandelar g\u00e5van avser. Om ni \u00e4r flera g\u00e5vogivare eller g\u00e5votagare m\u00e5ste det st\u00e5 vilka andelar som avses f\u00f6r respektive person.<\/p>\n\n\n\n<p>Vidare kr\u00e4vs det att g\u00e5vobrevet undertecknas av g\u00e5vogivaren och att g\u00e5votagaren samtycker till g\u00e5van och dess villkor genom sin underskrift, d\u00e4r \u00e4ven ort och datum ska framg\u00e5. Elektroniska signeringar \u00e4r inte giltiga vid \u00f6verl\u00e5telse av fastighet. Ett vanligt villkor \u00e4r att g\u00e5van ska utg\u00f6ra g\u00e5vomottagarens enskilda egendom. Ibland finns ocks\u00e5 villkor om att g\u00e5vogivaren ska beh\u00e5lla nyttjander\u00e4tten till fastigheten eller att n\u00e5gon ska ha f\u00f6rk\u00f6psr\u00e4tt om g\u00e5votagaren i framtiden vill s\u00e4lja fastigheten.<\/p>\n\n\n\n<p><strong>Blir g\u00e5van f\u00f6rskott p\u00e5 arv?&nbsp;<\/strong><\/p>\n\n\n\n<p>Jag f\u00e5r ofta fr\u00e5gan om g\u00e5van p\u00e5 n\u00e5got s\u00e4tt p\u00e5verkar arvet efter g\u00e5vogivaren. Huvudregeln \u00e4r att g\u00e5vor som ges till egna barn \u00e4r f\u00f6rskott p\u00e5 arv, medan g\u00e5vor till andra personer inte \u00e4r det.<\/p>\n\n\n\n<p>Som villkor f\u00f6r g\u00e5van kan givaren i g\u00e5vobrevet best\u00e4mma att g\u00e5van ska utg\u00f6ra f\u00f6rskott p\u00e5 arv eller inte. Oavsett vad du kommer fram till i denna del, \u00e4r det viktigt att redan innan g\u00e5van ges noggrant fundera igenom vad konsekvenserna blir f\u00f6r familjen. \u00a0Hur kan en tvist undvikas, b\u00e5de nu och i framtiden, om endast ett av barnen ska f\u00e5 g\u00e5van? Kanske kan det barn som inte erh\u00e5ller fastigheten f\u00e5 ett kontantbelopp ist\u00e4llet f\u00f6r att r\u00e4ttvisa ska uppn\u00e5s? T\u00e4nk ocks\u00e5 p\u00e5 att det \u00e4r viktigt att fastst\u00e4lla v\u00e4rdet p\u00e5 g\u00e5van, speciellt om g\u00e5van ska utg\u00f6ra f\u00f6rskott p\u00e5 arv. En oberoende marknadsv\u00e4rdering av fastigheten som ska ges bort \u00e4r d\u00e4rf\u00f6r bra att ordna. \u00a0<\/p>\n\n\n\n<p><strong>P\u00e5verkar g\u00e5vobrevet andra dokument?<\/strong><\/p>\n\n\n\n<p>Kanske har du i ditt testamente f\u00f6rordnat n\u00e5got specifikt ang\u00e5ende fastigheten som nu ges bort, det \u00e4r viktigt att komma ih\u00e5g i s\u00e5 fall. I samband med att g\u00e5van ges rekommenderar jag att du g\u00f6r en \u00f6versyn av alla dina familjer\u00e4ttsliga dokument.<\/p>\n\n\n\n<p><strong>Hur beskattas g\u00e5van?<\/strong><\/p>\n\n\n\n<p>G\u00e5voskatten avskaffades i Sverige \u00e5r 2004. Viktigt att notera \u00e4r dock att g\u00e5votagaren \u00f6vertar g\u00e5vogivarens (allts\u00e5 ditt) anskaffningsv\u00e4rde f\u00f6r fastigheten. N\u00e5got som bland annat f\u00e5r betydelse om mottagaren s\u00e4ljer fastigheten i framtiden och d\u00e5 ska deklarera f\u00f6r vinst eller f\u00f6rlust. &nbsp;<\/p>\n\n\n\n<p><strong>Hur s\u00f6ker man lagfart?<\/strong><\/p>\n\n\n\n<p>N\u00e4r g\u00e5van har \u00f6verl\u00e4mnats ska g\u00e5vomottagaren ans\u00f6ka hos Lantm\u00e4teriet om lagfart f\u00f6r att registrera det nya \u00e4gandet. Om en g\u00e5va av fastighet ges mellan tv\u00e5 makar m\u00e5ste den registreras hos Skatteverket innan lagfart kan beviljas.<\/p>\n\n\n\n<p>En lagfartsans\u00f6kan ska g\u00f6ras inom tre m\u00e5nader fr\u00e5n f\u00f6rv\u00e4rvet. Lagfartans\u00f6kan ska inneh\u00e5lla uppgift om fastighetsbeteckningen och g\u00e5vobrevet ska bifogas i original. Kontaktuppgifter till den person som ans\u00f6ker om lagfart m\u00e5ste ocks\u00e5 framg\u00e5.<\/p>\n\n\n\n<p>N\u00e4r \u00e4rendet \u00e4r handlagt skickar Lantm\u00e4teriet en faktura f\u00f6r expeditionsavgifter. Det kan vara bra att veta att en expeditionsavgift tas ut f\u00f6r varje f\u00f6rv\u00e4rvshandling.
